The Comptroller General of the Republic (CGR) has determined that there are technical deficiencies in the guarantees associated with development works for the new Viña del Mar Festival concession, covering the 2025-2028 period.

While the agency confirmed that the guarantees for contractual compliance and rent payments are legally sound, the ruling warned that specific amounts, conditions, and timelines for the development projects have not been defined.

According to reports from biobiochile.cl, the Comptroller's review was prompted by an inquiry from a private citizen seeking to verify the legality of the process and the oversight mechanisms for contract execution.

Instructions to the municipality

The technical report notes that the bidding terms included a minimum rent of 95,000 UF and development works valued at 42,000 UF.

Under this process, the concession was awarded to Megamedia S.A. alongside Bizarro Servicios SpA, with guarantees of 4,750.80 UF pledged for contract fulfillment and 19,003.4 UF to ensure rent payments.

The Comptroller General confirmed that these specific amounts do not present any irregularities and comply with current regulations.

However, the oversight body detected that the guarantees for the development works lack essential technical safeguards. Due to the lack of clarity regarding execution terms, the Comptroller has instructed the municipality of Viende del Mar to rectify these omissions within 15 business days.

The ruling also reminded the municipal council of its mandatory oversight role regarding this type of concession contract.

Finally, the institution demanded that the local administration strengthen regulations in future bidding processes to prevent similar legal loopholes.
